BENEV reaches agreement with US EPA; appoints new CFO

Oakville, Ontario-based BENEV Capital Inc. (BCI) announced October 3, 2012 that it negotiated a resolution to all outstanding issues with the U.S. Environmental Protection Agency (EPA).

At the time known as Bennett Environmental Inc., the company was notified in early 2012 that, as a result of certain documentary and procedural compliance deficiencies that occurred during the period prior to June 2011, the U.S.

EPA intended to bring proceedings against it to bar the company from accepting new U.S. federal government or related contracts for a period of five years.

Now, pursuant to the terms of the negotiated Administrative Agreement executed by the parties, BCI has agreed to undertake certain reporting, certification, and monitoring requirements designed to confirm that BCI is a responsible contractor. The agreement extends for two years. To the extent BCI satisfies the terms of the agreement, the EPA agrees not to exclude BCI from performing work for the U.S. Government.

BCI says it’s pleased with this outcome, and has already taken steps and implemented systems to ensure compliance with the agreement's terms.

In addition, BCI has appointed Ian Kidson to Chief Financial Officer of Progressive Waste Solutions Ltd. As a result, Kidson has stepped down from the BCI Board.
